Artist Unites is committed to providing the best quality Artwork, giving you the satisfaction from browsing through our collection, ordering and purchasing Made To Order Commission and Made To Order Artwork and that Artist Unites provides you with a professional service.

We require you to read our Terms and Conditions as stated below before you place your order(s) and purchase(s). We want to protect your interests so you can rely on Artist Unites so you will visit us again and again.

By clicking the tick box ‘I have read and agree to the Terms & Conditions’ you have therefore entered a legally binding agreement with Artist Unites. (Hereafter referred to as “we” “our” “us” or “Artist Unites”).(When we use “we” “our” “us” this is referring to “Artist Unites”).(When we use “you” “yours” this is referring to you the customer/client/buyer). If you would like further information before you purchase then please contact us via email click on the ‘Contact’ tab in the Menu Bar on our Website and send us your details and the Information you require.

Once an order/purchase is placed on the Website of Artist Unites you are entering a binding contract and you are in agreement with us in accordance with the following Terms and Conditions.

All Artwork layouts and designs are the ownership and copyrighted to Artist Unites and it’s owner, all images are the ownership and copyrighted to Artist Unites and it’s owner. Artist Unites company name, logo and content are copyright to Artist Unites and it’s owner.

It is your responsibility to ensure you check the Terms and Conditions each and every time you place an order/purchase as we have the right to change the Terms and Conditions without prior notice. Please read these Terms and Conditions carefully before ordering/purchasing any Artwork from the Artist Unites Website.

Artist Unites strongly advises and highly recommends that you CHECK and INSPECT the Artwork(s) that is delivered to you by the courier company before accepting the Artwork(s), and DO NOT sign any documentation or digital device until you are satisfied that it is (i) the correct Artwork(s) you ordered/purchased, and (ii) the Artwork(s) is not damaged. When you are satisfied and you accept the Artwork(s) you are accepting liability and possession of the Artwork(s).

If for the reasons listed in the Terms and Condition you return the Artwork(s) back to Artist Unites we strongly advise and highly recommend that you send the Artwork(s) back using a Recorded Delivery or another Secure Delivery method. It is your responsibility to ensure the Artwork(s) is safely packaged and please ensure that is is packaged in the original packaging. You are liable for the Artwork(s).

1. Disclaimer.

1.1 Artist Unites warrants that all Artwork(s) sold via Made To Order Commission or Made To Order Artwork on this Website are of Satisfactory quality. Specifications on this Website of the Artwork(s) via Made To Order Commission or Made To Order Artwork to be sold are not intended to be binding and are intended only to give a general description of the Artwork(s).

1.2 Artist Unites makes no warranties or promises about the Artwork(s) and any implied warranties are excluded.

1.3 Every piece(s) of Artwork(s) that is created by Artist Unites using either Canvas (Acrylic), Watercolour Paint, Gouache Paint, Ready Mix Paint and Drawing Ink is hand painted, but it is possible that as much as every effort is made to ensure an exact copy and an exact copy of the colours used, the Artwork(s) will not be an exact replica of the original shown in our collection on our Website, or from any other source which displays our Artwork(s) and anyone purchasing a piece of Artwork(s) accepts this. The Artwork(s) will never be exactly the same as the Artwork(s) shown elsewhere.

1.4 The colours of the Artwork(s) displayed on our Website will vary slightly depending on camera lighting and monitor, TV, mobile phone settings plus any other visual equipment which displays images of Artwork(s) produced by Artist Unites.

1.5 Every piece(s) of Artwork(s) in our collection produced by Artist Unites has a description including the size of the Artwork(s) (Canvas and Framed). These sizes are approximate as each piece(s) of Artwork(s) is hand made, the frames can alter in size due to stretching and humidity conditions, also as timber is a natural resource it can alter shape and size in different conditions. The description does state sizes as approximate and as much effort is made to ensure an exact size Artist Unites is not liable for slight differences in sizes on receipt and possession of our Artwork(s) by you. Timber, Canvas Material, Acrylic Paint, Watercolour Paint, Gouache Paint, Ready Mix Paint and Drawing Ink all react to changing environments, reaction to heat and cold wet and dry conditions, also all liquids of any description or sharp instruments of any description and objects of any description.

1.6 Artist Unites uses high quality materials but Artist Unites is not liable for any of our Artwork(s) which may change appearance due to these elements listed as well as elements within an environment where our materials are not adapted to changeable conditions.

1.7 The warranty contained in your purchase is subject to the following conditions: (i) The Artwork(s) must be stored in appropriate conditions, if you do not store them in appropriate conditions Artist Unites cannot be held responsible and liable for faults or problems that arise as a result. (ii) Any claim by you in respect of any shortages and/or defects in the Artwork(s) must be notified to us in accordance with these Terms and Conditions, stating the nature of the shortage/defect and quoting the invoice number, if you fail to notify us within the time scale and in the method of contact stated in these Terms and Conditions you will be deemed to have accepted the Artwork(s) you purchased.

1.8 The Artwork(s) shown throughout the Artist Unites Website may contain other images and backgrounds that are there for effect only to emphasize the Artwork(s). Only the Artwork either as a Canvas piece(s) of Artwork(s) or a Framed piece(s) of Artwork(s) is for sale and no other items, images or construction is included. The Artwork(s) shown which include images and backgrounds may seem larger or smaller again this is done to show what effect could be achieved if you choose to order the approximate size shown, but as a Made To Order Commission or a Made To Order Artwork you have the option to pick the size you require therefore creating a personalised piece(s) of Artwork(s).

2. Made to Order Commission.

2.1 All our Artwork(s) displayed on our Website at Artist Unites is sold under Made to Order Commission basis only, we do not carry stock and most of our work is Limited Edition. As a customer/client/buyer you are requesting the Artwork(s) you select in the order/purchase process to be carried out as a Made To Order Commission piece(s) of Artwork(s), therefore you are entering a legally binding contract between you the customer/client/buyer and us Artist Unites and the Artist.

2.2 The cancellation policy or refund policy does to apply to Made To Order Commission. Only faulty or the incorrect Artwork(s) can be returned which will be replaced with a new piece(s) of Artwork(s) or the correct piece(s) of Artwork(s).

2.3 All liaisons regarding the sale or requirements will go through our Website.

2.4 A Made To Order Commission is different from a Made To Order Artwork service, a Made To Order Commission you require the Artwork(s) that is displayed on our Website and any orders/purchases you make from our Website this will then generate an order to produce a new piece(s) of Artwork(s) from the order you placed as Artist Unites. Artist Unites does not stock quantities of Artwork(s) displayed on our Website as every piece of Canvas Artwork(s) is hand painted. We produce our Artwork(s) exclusively on a customers/clients/buyers request which is activated upon an order/purchase.

2.5.1 All Made To Order Commissions are subject to the Terms and Conditions set out on our Website.

2.6 All our Artwork(s) displayed on our Website at Artist Unites can be ordered/purchased under a Made To Order Commission basis only on any of our piece(s) of Artwork(s) displayed on our Website. Once you order/purchase a Made To Order Commission piece(s) of Artwork(s) through our Website the order/purchase is too be paid in full upon order/purchase.

2.7 Once the order/purchase has been completed the individual Made To Order Commissioned piece of Artwork can take up to 30 days to complete once payment has been confirmed, approved and accepted, this depends on existing orders at the time of the order/purchase. We will keep you informed during the Artwork(s) process and we will give you a completion date during that time, however it is possible this could vary given existing orders but we will aim to complete by the date we give you.

2.8 Artist Unites is not liable for any errors you make during your selecting/ordering/purchasing of any of our Artwork(s), Made To Order Commission or Made To Order Artwork.

2.9 Please note that because all Artwork(s) produced at Artist Unites is hand painted as much as every effort is made to ensure an exact copy and an exact copy of the colours used, the Artwork(s) will not be an exact replica of the original shown in our collection on our Website or from any other source which displays our Artwork(s) and anyone purchasing a Made To Order Artwork piece of Artwork(s) accepts this. The Artwork will never be exactly the same as the Artwork(s) shown elsewhere.

3. Made to Order Artwork.

3.1 A Made To Order Artwork is an legally binding contract between you the customer/client/buyer and us Artist Unites and the Artist.

3.2 The cancellation policy or refund policy does to apply to Made To Order Artwork. Only faulty or the incorrect Artwork(s) can be returned which will be replaced with a new piece(s) of Artwork(s) or the correct piece(s) of Artwork(s).

3.3 All liaisons regarding the sale or requirements will be made via email.

3.4 A Made To Order Artwork service is different from just a Made To Order Commission, as a Made To Order Artwork Service you can choose from two different aspects from our Made To Order Artwork Service.

3.5 One service is for you to contact us by going to the ‘Contact’ tab in the Menu Bar on our Website and enquire by sending us your details and the Information you require about any of our existing Artwork(s) in our collection displayed on our Website which you like but you would prefer in a different colour(s) or size(s) to suit your your own requirements, then it may be possible we could alter our Artwork(s) to suit your specifications. However Artist Unites will not alter the overall layout or design of the Artwork(s) only the colour(s) and size(s) of the Artwork(s) with regards Artwork(s) in our collection displayed on our Website.

3.6 Please note not all all our Artwork(s) collection displayed on our Website can be altered, the Artwork(s) that can be altered will display the ‘Made To Order’ tag listed in the Artwork(s) description details.

3.7 The other service is if you have any special requirements or have any designs of your own for example:- A Photograph you wish to be converted into a Painting, or a special occasion or even a memorable location which you either would like on Canvas or Framed Artwork(s), or any other requests that will match your needs. Then please contact us via email click on the ‘Contact’ tab in the Menu Bar and send us your details and specifications that you require. We will then decide if the Artwork(s) is possible to produce given your requirements. If so you therefore:-

3.8.1 All Made To Order Artwork is subject to the Terms and Conditions set out on our Website.

3.9 All Made To Order Artwork is to be paid in full before the Artwork is to be started and a Made To Order Artwork order will vary in price depending on sizes, colours and the general design.

3.10 A Made To Order Artwork piece(s) of Artwork(s) which matches in size to any of our Artwork(s) shown in our collection displayed on our Website, does not automatically match the same price shown on any in our collection. Every Made To Order Artwork piece(s) of Artwork(s) produced is priced individually regardless of size, colour or image produced.

3.11 Once we receive your requirements we will check as to whether the specific Artwork(s) you require can be altered in colour(s) or size(s) if we can alter the specific Artwork(s) we will send you a confirmation of this via email.

3.12 We will then require an order/agreement/Terms and Conditions/final approval form to be completed by you which will be sent with the confirmation. The order/agreement/Terms and Conditions/final approval form will state your details and the details of the specific Artwork(s) the alterations you require, an image of your required alterations of the specific Artwork(s) for your approval and also a payment request for the full fee for the Artwork(s).

3.13 It is vitally important and your responsibility in which Artist Unites is not liable, is that you must make sure that if you require a Made To Order Artwork piece(s) of Artwork(s) from our collection displayed on our Website and such piece(s) of Artwork(s) can be altered which in the description of the Artwork(s) it will state this, is that you first contact us by going to the ‘Contact’ tab in the Menu Bar on our Website to enquire about the particular piece(s) of Artwork(s) you would like with any specifications you would like, BEFORE ordering/purchasing the particular Artwork(s).

3.14 If you do not contact us with an enquiry regarding a piece(s) of Artwork(s) from our collection displayed on our Website to clarify your requirements and specifications before the order/purchase, the order/purchase will be activated and the Artwork(s) you selected will be produced and sent to the specifications on the description of the Artwork(s) on our Website.

3.15 Artist Unites is not liable for any errors you make during your selecting/ordering/purchasing of any of our Artwork(s), Made To Order Commission or Made To Order Artwork.

3.16 Approval – If we are able to commence with the Made To Order Artwork then we will contact you via email with a total price and an order/agreement/final approval form, however once the order/agreement/Terms and Conditions/final approval form is returned by you then no changes can be made. Artist Unites is not liable for any errors you make during this process and if you request any changes after we receive the order/agreement approval form from you then any changes will incur further costs.

3.17 If you do require changes to the Artwork(s) because of any errors you have made and these changes incur further costs, these costs must be paid in full before the Artwork(s) will be altered, we will send you a further image and an agreement/Terms and Conditions/approval form which must be sent back to us before we commence with the work and to complete the Artwork(s) and send to you.

3.18 Once we receive the initial order/purchase and the agreement/Terms and Conditions/approval the individual Made To Order Artwork piece of Artwork can take up to 30 days to complete once payment has been confirmed approved and accepted., this depends on existing orders at the time of the order/purchase and also any changes or approvals we require from you which may delay the completion date. Artist Unites is not liable for any delays caused by you. We will keep you informed during the Artwork(s) process and we will give you a completion date during that time, however it is possible this could vary given existing orders but we will aim to complete by the date we give you.

3.19 Once completed we will send you an image via email to confirm the completed Artwork(s) and also a final approval form will be sent, which must be returned to Artist Unites before we will send you the Artwork(s).

3.20 Please note that because all Artwork(s) produced at Artist Unites is hand painted as much as every effort is made to ensure an exact copy and an exact copy of the colours used, the Artwork(s) will not be an exact replica of the original shown in our collection on our Website or from any other source which displays our Artwork(s) and anyone purchasing a Made To Order Artwork piece of Artwork(s) accepts this. 3.22 All Artwork(s) will be produced once payment has been confirmed approved and accepted and the 30 days to completion will begin.

4. Use of Website.

4.1 Under no exceptions can this Website be used for any other reason other than what is designed to be used for by these Terms and Conditions. Copyright law protects all images and copy content and any unlawful usage will be deemed as a breech of contract and unlawful. All Artwork layouts and designs are the ownership and copyrighted to Artist Unites, it’s owner and the Artist, all images are the ownership and copyrighted to Artist Unites, it’s owner and the Artist. Artist Unites company name, logo and content are copyright to Artist Unites and it’s owner.

4.2 If you do not agree to these terms then please stop using our Website and our services. All content, information and blogs has been checked for accuracy, however if there are any errors/faults in anything on our Website then please contact us via email, go to the ‘Contact’ tab in the Menu Bar on our Website. No Law Suit can be brought against Artist Unites or its owner or any of our affiliates for inaccurate content under these Terms and Conditions. Nor are we liable for any errors anywhere on our Website.

4.3 You may use this Website for personal use but are not permitted to copy, download anything off this Website for personal or commercial use.

4.4 Artist Unites is not liable or responsible for any connection problems you may get during your visit to our Website.

4.5 Artist Unites is not liable or responsible for any Internet problems you may experience during or after visiting our Website.

4.6 Artist Unites is not liable or responsible for any virus’s or spam you may experience during or after visiting our Website.

4.7 Artist Unites does use an external Web Host and Artist Unites is not liable or responsible for any problems they experience which in turn may cause a disruption in our service to you.

5. Our Agreement.

5.1 Artist Unites and the Artist will sell to you and you shall purchase only the Artwork(s) which you have set out in an order and which have been accepted by Artist Unites and the Artist. We reserve the right to reject any order. Unless otherwise agreed in writing each such sale of Artwork(s) will be the subject to these Terms and Conditions.

5.2 An email will be sent once your order/purchase has been accepted, until that point no order/purchased has been confirmed.

5.3 We have the right to refuse any order/purchase without explanation as deemed by these Terms and Conditions.

5.4 Every order/purchase is bound by the agreement of these Terms and Conditions, however these Terms and Conditions can change at any point under the discretion of Artist Unites and we recommend you check back to these Terms and Conditions of every order/purchase you make.

6. Orders(s).

6.1 By purchasing your selected order(s) either a Made To Order Commission or Made To Order Artwork, you agree to these Terms and Conditions.

6.2 Please carefully check your personal details and the details of the Artwork(s) before completing the purchase(s), by completing and submitting the electronic order/purchase you are making an offer to purchase the Artwork(s) which, if accepted by us will result in a binding contract (which this is not filed by us).

6.3 As detailed above orders/purchases are accepted at our discretion.

6.4 Acceptance is based upon if the Artwork(s) is re-producible, the orders/purchases are subject to the price at the time of ordering/purchasing.

6.5 We also check that your payment has been authorized before we commence with the order. We have the right to change prices of any of our Artwork(s) at any time. However the price at the time of your order/purchase will be secured at that price.

6.6 A description is given to each piece(s) of Artwork(s), parts of the description are approximates, it is your responsibility to check the description before ordering and purchasing. Artist Unites is not liable for any inaccuracies as we state that the descriptions are approximates and varied.

6.7 Artwork(s) ordered/purchased through our Website will take up to 30 working days for the Artwork(s) to be completed, once payment has been accepted and confirmed. (See the Delivery section in the Terms and Conditions).

6.8 If you order/purchase multiple piece(s) of Artwork(s) through our Made To Order Commission basis we will aim for you to receive the Artwork(s) within 30 days once payment has been accepted and confirmed. However many of our pieces of Artwork(s) is Limited Edition and we may not produce any more piece(s) of the Artwork(s) you selected so please check with us first before ordering. Contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website and send us your request regarding the piece(s) of Artwork(s) you require and we will reply with the information you require.

6.9 If a large quantity is ordered and accepted by us we will contact you via email with dates regarding completion of other Artwork(s). We will produce the Artwork(s) that is the first piece of Artwork on the order/purchase. If you require a piece of Artwork you ordered/purchased in a multiple order and this was not the first piece of Artwork you ordered/purchased, then please contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website and send us an email regarding your requirements within 24 Hours (2 Days) of your initial order. After 24 Hours (2 Days) of your order/purchase we will continue with the order/purchase proceeding with the first piece of Artwork from your order/purchase you placed with us.

6.10 We are not liable or responsible at Artist Unites for any errors you make during the order(s) purchase(s) process of any Artwork(s) through our Website such as the incorrect Artwork(s) selected, the incorrect size(s) selected or the incorrect quantities selected by you.

6.11 It is your responsibility to correctly order/purchase any Artwork(s) from the Artist Unites Website.

6.12 We are not liable or responsible at Artist Unites for any errors you make during the order(s)/purchase(s) regarding your personal information such as your name and address and delivery address you input through the ordering and purchasing process on our Website. Artist Unites will send the Artwork(s) you ordered/purchased to the name and address stated by you in the ordering and purchasing process.

6.13 It is your responsibility to correctly input your personal details through either the Paypal Website during payment or on the Artist Unites Website regarding Information, specifications or enquiries.

6.14 It is vitally important and your responsibility in which Artist Unites is not liable for, is that must make sure that if you require a Made To Order Artwork piece(s) of Artwork(s) from our collection displayed on our Website, and such piece(s) of Artwork(s) can be altered which in the description of the Artwork(s) it will state this, is that you must first contact us by going to the ‘Contact’ tab in the Menu Bar on our Website to enquire about the particular piece(s) of Artwork(s) you would like with any specifications you would like, BEFORE ordering/purchasing the particular Artwork(s).

6.15 If you do not contact us with an enquiry regarding a piece(s) of Artwork(s) from our collection displayed on our Website to clarify your requirements and specifications before the order/purchase, the order/purchase will be activated and the Artwork(s) you selected will be produced and sent to the specifications on the description of the Artwork(s) on our Website.

6.16 Artist Unites is not liable for any errors you make during your selecting/ordering/purchasing of any of our Artwork(s), Made To Order Commission or Made To Order Artwork.

7. Pricing – Fees.

7.1 Made To Order Commission and Made To Order Artwork(s) must be paid in full when you order from our collection displayed on our Website or from your own personal Commission before the Artwork(s) can commence, be completed and sent to you. There are no exceptions.

7.2 All Made To Order Commission and Made To Order Artwork(s) must be paid in full, we must receive all agreements and approvals before the Artwork(s) can commence, be completed and sent to you. There are no exceptions.

7.3 Prices will be clearly shown of each and every piece of Artwork(s) shown in our collection displayed on our Website. However we reserve the right to change the prices of any piece of Artwork(s) at any time without notification, unless an order has been placed then the price will be valid at the time of the order.

7.4 If you make any enquiry via email about a Made To Order Commission or a Made To Order Artwork piece of Artwork(s), then the price we quote you will stand which covers the Artwork(s) and the delivery to you, this quote will be valid for 30 days.

7.5 After 30 days please contact us to arrange a new quote.

7.6 If the order/agreement/final approval and payment is sent to Artist Unites within 30 days and you decide that you wish to have any alterations then the total fee remaining will change accordingly, any changes after payment will result in further costs and this must in paid in full before the Artwork(s) can be delivered to you.

7.7 If you contact us to change your delivery details then the price may change depending on the address, this must be paid in full before the Artwork(s) can be delivered to you.

7.9 The cancellation policy or refund policy does to apply to Made To Order Commission and the Made To Order Artwork. Only faulty or the incorrect Artwork(s) can be returned which will be replaced with a new piece(s) of Artwork(s) or the correct piece(s) of Artwork(s).

7.10 If you make an enquiry via email about a Made To Order Commission or a Made To Order Artwork piece of Artwork(s) then the price we quote you will stand which covers the Artwork(s) and the delivery to you, this quote will be valid for 30 days, after 30 days please contact us to arrange a new quote. However if the order/agreement/approval and the fee paid in full is sent to Artist Unites within 30 days and you decide to change or you wish any other alterations then an extra fee will be charged accordingly and this must be paid in full before the Artwork(s) can be delivered to you.

7.8 If you decide after ordering/agreeing/approving and paying the full fee on a Made To Order Artwork piece of Artwork(s) and you decide that you wish to change your mind or cancel the order, you will not be entitled to a refund and the Artwork(s) you paid for will still be produced and delivered to you.

7.9 If the Artwork(s) is returned to us by the courier company it will go into storage and remain your property which you can retrieve back at any time, however if you request the Artwork(s) to be delivered again you will be charged a delivery charge which must be paid in full before the Artwork(s) is delivered to you.

7.10 If the Artwork(s) that is delivered to you is faulty or incorrect at the time of delivery and it is checked as we recommend before signing for the Artwork(s), then refusal to accept will result in the Artwork(s) return to us. You will not be charged any fees for this as it will be for the courier company and Artist Unites responsibility. A new or correct piece(s) of Artwork(s) will be re-sent and again would recommend you check the Artwork(s) before signing, accepting and taking possession of the Artwork(s).

7.11 If you do sign for the Artwork(s) from the courier company and once you open the packaging if the incorrect Artwork(s) has been sent by mistake then you must contact us via email by going to the ‘Contact’ tab on our Website and inform us within 36 Hours (3 Days) of receipt of the Artwork(s). Please send your Invoice Number and also the Reference Number that comes with the Artwork(s) which will be attached to the back of the Artwork(s). We will send the courier company to pick up the incorrect Artwork(s) at a time and date set by you and once we have received the Artwork(s) which must be returned in its original packaging and in the same condition you received the Artwork(s), we will then send you the correct Artwork(s).

7.12 If you do not contact us within 36 Hours (3 Days) of receipt of the incorrect Artwork(s) that you have received then it is your responsibility and at your expense to send the Artwork back to Artist Unites, we will not be responsible for any loss or damage to the Artwork(s) during transit and we recommend you use a Recorded Delivery or Secure Delivery method. If the Artwork(s) is lost in transit back to Artist Unites you will not be sent the correct piece of Artwork(s). You are then responsible to seek a claim against whom you chose to arrange delivery and seek financial damages to the amount with which the Artwork(s) cost and to arrange payment to Artist Unites. Once payment is made we will immediately send the correct Artwork(s). If we do receive the incorrect Artwork(s) and the Artwork(s) is damaged we will fully investigate the damage and arrange an inspection to examine the Artwork(s) to clarify who is liable. We will contact you and we will require the delivery details you have and we will make contact to determine liability. If liability is with whom delivered the Artwork(s) back to Artist Unites then it will be your responsibility to seek a claim against whom you chose to arrange delivery and seek financial damages to the amount with which the Artwork(s) cost and to arrange payment to Artist Unites .Once payment is made we will immediately send a new piece(s) of Artwork(s). Artist Unites will provide you with evidence such as photographs to help you with your claim against whom you chose to use to deliver the Artwork(s) back to Artist Unites. If with whom you chose to delivery the Artwork(s) denies liability then it is your responsibility to make a claim against whom you chose to arrange delivery and seek financial damages to the amount with which the Artwork(s) cost and to arrange payment to Artist Unites. Once payment is made we will immediately send the correct Artwork(s). Artist Unites will provide you with evidence such as photographs to help you with your claim against whom you chose to use to deliver the Artwork(s) back to Artist Unites.

7.13 Artist Unites will not re-send any Artwork(s) until we have received the original Artwork(s) back in the condition it was sent, or payment to the cost of the Artwork(s) has been paid.

7.14 All returned Artwork(s) incorrect or damaged must be sent back in either the same packaging or packaging of your own and packaged safely and to protect the Artwork(s).

7.15 If you do sign for the Artwork(s) from the courier company and once you open the packaging if the Artwork(s) is/are damaged then you must contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website and inform us within 36 Hours (3 days) of receipt of the Artwork(s). Please send your Invoice Number and the Reference Number that comes with the Artwork(s) which will be attached to the back of the Artwork(s) and a brief description of the damage. We will send the courier company to pick up the damaged Artwork(s) at a time and date set by you and once we have received the Artwork(s) which must be returned in its original packaging and in the same condition you received the Artwork(s) even though the Artwork(s) is damaged. Artist Unites will fully investigate the damage we will arrange an inspection to examine the Artwork(s) to clarify who is liable. If the courier company accepts liability then we will send you a new piece(s) of Artwork(s) immediately. If the courier company does not accept liability we at Artist Unites has video records and photographic records of each piece(s) of Artwork(s) that is packaged and sent, the liability will be with you and it is your responsibility to show evidence that the damage was not caused by you. If Artist Unites accepts liability we will send you a new piece(s) of Artwork(s) immediately.

7.16 If you do not contact us within 36 Hours (3 Days) of receipt of the damaged Artwork(s) then you accept liability and Artist Unites shall have no liability for any damages.

7.17 If you do not contact us within 36 Hours (3 Days) of receipt of the damaged Artwork(s) that you have received and you wish to send the Artwork back of your own choice even though after 36 Hours (3 Days) you have accepted the damaged Artwork(s) and accept liability then it is your responsibility and at your expense to send the Artwork back to Artist Unites, we will not be responsible for any loss or further damage to the Artwork(s) that was described in your description during transit and we recommend you use a recorded or secure delivery method. If the Artwork(s) is lost in transit back to Artist Unites you even though the Artwork(s) is damaged a new piece(s) of Artwork(s) will not be sent. You are then responsible to seek a claim against whom you chose to arrange delivery and seek financial damages to the amount with which the Artwork(s) cost and to arrange payment to Artist Unites. Once payment is made we will immediately send a new piece(s) of Artwork(s). If we do receive the damaged Artwork(s) we will fully investigate the damage and arrange an inspection to examine the Artwork(s) to clarify who is liable. We will contact the courier company we used to assess liability and if the courier company accepts liability we will send you a new piece(s) of Artwork(s) immediately. If the courier company does not accept liability we at Artist Unites has video records and photographic records of each piece(s) of Artwork(s) that is packaged and sent, the liability will be with you and it is your responsibility to show evidence that the damage was not caused by you. If Artist Unites accepts liability we will send you a new piece(s) of Artwork(s) immediately.

7.18 Artist Unites strongly advises and highly recommends that you DO NOT SIGN for the Artwork(s) that is delivered by the courier company until you inspect the Artwork(s) and accept possession of the Artwork(s).

7.19 UK insured postage and packaging costs are included in the total price unless as stated in the Terms and Conditions as above.

7.20 For international sales there will an additional charge made relative to the size and amount of the Artwork(s) insured for postage and packaging. This charge is available upon request but the price may change on a daily basis so please contact us for a price.

7.21 Artist Unites provides a free shipping service within the U.K but this is only for the first initial delivery of the purchased Artwork(s), if the first initial delivery is not successful then we have the right to charge a fee to re-deliver. It is important that you provide us with your details accurately, especially a delivery address. It is your responsibility to ensure you have checked your details that you have submitted to where you want the Artwork(s) to be delivered to at the time of your order/purchase. You will incur extra costs if you fail to do so as stated in the Terms and Conditions. You are agreeing to these Terms and Conditions at the time of your order/purchase.

7.22 Some courier services will after numerous delivery attempts possibly send back to package containing the Artwork(s) back to Artist Unites. If this is the case it is then your responsibility to contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website and provide us with details to re-deliver the Artwork(s). However a delivery fee will now be charged by Artist Unites and this must be paid before the Artwork(s) can be sent to you. If you do not contact us it will be kept in storage at Artist Unites until you do contact us, nor will the Artwork(s) be sent until the delivery charge is paid.

7.23 If you provide us with the incorrect address for delivery and the courier service we use return the package containing your purchased Artwork(s). We will contact you regarding this issue with the details you have submitted at the time of your order/purchase.

7.24 Once you have received our email then it is your responsibility to contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website . Inform us of the correct details for where the Artwork(s) is to be delivered, however a delivery fee will now be charged by Artist Unites and this must be paid before the Artwork(s) can be sent to you. If you do not contact us it will be kept in storage at Artist Unites until you contact us. Also the Artwork(s) will not be sent until the delivery charge is paid.

7.25 It is your responsibility to ensure you or anyone who receives the package(s) containing the Artwork(s) which is delivered by the courier to check thoroughly before you sign for delivery for any damages, also SOME courier services provide delivery receipts that have an option ‘NOT CHECKED’ if you have any doubts about the condition of the package(s). If you do not check the Artwork(s) within the packaging which is delivered before you sign for the package containing the Artwork(s), or sign the ‘NOT CHECKED’ box then it will invalidate any claim for a replacement from Artist Unites if the courier company is liable for the damage, or for you to make a claim against the courier company if they are liable for any damages. Artist Unites strongly advises and highly recommends you check the Artwork(s) before accepting possession of the Artwork(s).

7.26 Artist Unites is not responsible or is liable for any claim you make against the courier company. However at request we will supply you with photographic evidence to help with your claim against the courier company but Artist Unites is not responsible for any further part of the claim.

7.27 No VAT is currently charged on any Artwork(s) purchased, however this may change at any time, if so the VAT will show on the total cost when you make your order/purchase.

7.28 All Artwork layouts and designs are the ownership and copyrighted to Artist Unites and it’s owner, all images are the ownership and copyrighted to Artist Unites and it’s owner. Artist Unites company name, logo and content are copyright to Artist Unites and it’s owner. Once you have paid and received your Artwork(s) the Artwork(s) is now under your possession, the Artwork layouts, designs are still under copyright law owned by Artist Unites and it’s owner.

7.29 It is against the law to re-sell our Artwork(s) under our company name ‘Artist Unites’, however you are allowed to sell the Artwork(s) under the Artist’s name. Artist Unites and it’s owner and the Artist is not liable for any costs, fees or postage costs that you incur in the process of selling the Artwork(s).

7.30 The Artist is not liable for any process during the re-selling of the Artwork(s), it is against the law to use the Artist’s name falsely, it is against the law to portray yourself as the Artist and all the Artwork(s) produced by the Artist has sole ownership and is covered by copyright law.

7.31 You are not allowed to copy our Artwork(s) either by hand or by digital copying to re-sell under our company name ‘Artist Unites’ or the Artist. Nor can you pass the Artwork(s) off as your own or with the knowledge of other parties are re-selling the Artwork(s).

8. Terms of Payment.

8.1 Once an order/purchase has been placed and we have received your details and payment, you are confirming that all the information contained within the order is true and accurate and that you are authorized to make payment. You are entering a legally binding contract with us, giving Paypal permission to deduct the full price of the Artwork(s) from the payment details you have given Paypal.

8.2 We have the right to cancel any orders and if any details are falsely given to us we would cancel, suspend any Artwork(s) delivered to you and report this to the authorities.

8.3 We currently use Paypal as our form of payment, it will be possible that further methods of payment will be available to customers/clients/buyers in the future. These methods of payment will be listed on our Website giving you the option to decide which method of payment suits you.

8.4 Credit Card, Debit Cards or any other Bankers Card information or Payment information is not held by Artist Unites, all financial transactions are processed through Paypal, Cheque or Cash. View Paypal’s privacy policy on their Website. If a incorrect payment is deducted from your account via whichever method of payment you chose, Artist Unites cannot be held liable for any mistakes or losses to you. Paypal is our chosen method of payment, all responsibility of payment is under Paypal.

8.5 As stated we do not hold financial information about you at Artist Unites, but the information we do hold such as your name and address, we do not share or pass on your personal information to any third parties other than required by law.

9. Delivery, Free Shipping and Returns (a).

9.1 Artist Unites provides a free shipping service within the U.K but this is only for the first initial delivery of the purchased Artwork(s), if the first initial delivery is not successful then we have the right to charge a fee to re-deliver. It is important that you provide us with your details accurately, especially a delivery address. It is your responsibility to ensure you have checked your details that you have submitted to where you want the Artwork(s) to be delivered to at the time of your order/purchase. You will incur extra costs if you fail to do so as stated in the Terms and Conditions. You are agreeing to these Terms and Conditions at the time of your order/purchase.

9.2 It is your responsibility to ensure someone is available to sign for the package containing the Artwork(s) from our chosen courier. Once you have received the package containing the Artwork you are responsible for it.

9.3 We will inform as accurately as possible the delivery date of your purchased Artwork(s), we aim to have the Artwork(s) delivered to in within 30 working days from the date you completed your order/purchase and once payment has been confirmed, approved and accepted however this may change depending on workload.

9.4 We are not accountable or liable for any delays beyond our control and purchasing from us you are agreeing to these Terms and Conditions.

9.5 We use different external courier services and Artist Unites has no connection to the courier services that we use at the time other than it’s purpose as a courier service. Artist Unites is not financially or contractually connected, nor is Artist Unites is in partnership or owned by any courier service.

9.6 We are not liable for any delays caused by the courier services we use, nor are we responsible or liable if the courier service cannot find your address. It will be your responsibility to take this issue up with the courier service and any other business or company.

9.7 If you choose to order/purchase multiple piece(s) of Artwork(s) from Artist Unites, please note that depending on size(s), quantities, Made To Order Commission or Made To Order Artwork then it’s possible they could be sent in instalments on various dates. It may be possible given the details that depending on the Artwork(s) purchased that we could send more than one piece(s) of Artwork(s) in one package but this is at our discretion. However an order/purchase of a piece of Artwork including delivery is dealt as an individual contract and multiple order(s)/purchase(s) of Artworks are not as one whole contract and therefore the Terms and Conditions are dealt as individually and not as one entity.

9.8 Artist Unites provides you with initial free shipping, we have the right to send the Artwork(s) as and when we wish. We will aim to accurately inform you of any dates regarding delivery but we are not liable for delays by the courier or if the courier cannot find your address.

9.9 The courier service we use for your Artwork(s) will attempt to deliver the Artwork(s) to the address you gave Artist Unites during your submission/order/purchase. This will be the address they deliver too and its your responsibility to make sure you are available to receive the package containing the Artwork(s).

9.11 If you are not available at the time of the first initial delivery then it is the responsibility of the courier and yourself to arrange a second delivery.

9.12 Artist Unites is not responsible for any arrangements about a second or any other numerous delivery attempts after the first initial delivery attempt.

9.13 Some courier services will after numerous delivery attempts possibly send back to package containing the Artwork(s) back to Artist Unites. If this is the case it is then your responsibility to contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website and provide us with details to re-deliver the Artwork(s). 9.12 Not all couriers we use at Artist Unites are insured during transit to the destination. All Artwork(s) sent to you is marked ‘FRAGILE HANDLE WITH CARE’ on the packaging. However in the unlikely event to Artwork is damaged when you inspect it which it is your responsibility to do so, and you refuse to take delivery of it from the couriers then you must contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website and inform us within 36 Hours (3 Days) of the courier arriving at your address. Please inform us in detail about what exactly is damaged with the Artwork(s) and please make a note of the time the courier arrived to deliver the Artwork(s). We will then contact the courier to firstly investigate this matter and to seek liability and we will keep you informed of the situation.

9.13 If the Artwork(s) is damaged do not sign or accept the Artwork(s) and ask the courier to return the Artwork(s) and contact us within 36 Hours (3 Days)

9.14 If you accept delivery and sign for the delivery of the Artwork(s) and once you have opened the packaging to discover the Artwork is damaged, you must contact us within 36 Hours (3 Days) via email by going to the ‘Contact’ tab in the Menu Bar on our Website and please inform us in detail about what exactly is damaged with the Artwork(s) and please make a note of the time you took delivery of the Artwork(s). We will then contact the courier to firstly investigate this matter and to seek liability and we will keep you informed of the situation. If the courier company does not accept liability and provides us with proof that the Artwork(s) delivered was undamaged when it was delivered then liability is with you and it will be your responsibility to make a claim against the courier company, Artist Unites will not take responsibility or is liable for any claim you make against the courier company and Artist Unites is not liable for any damages.

9.15 If you do not contact us within 36 Hours (3 Days) then we will take no action and you are solely responsible for any investigation or claim against the courier company, Artist Unites will not take responsibility or is liable for any claim you make against the courier company and Artist Unites is not liable for any damages or losses.

9.16 If you accept delivery and sign for the delivery of the Artwork(s) and once you have opened the packaging to discover the Artwork is damaged, you must contact us within 36 Hours (3 Days) via email by going to the ‘Contact’ tab in the Menu Bar on our Website and please inform us in detail about what exactly is damaged with the Artwork(s) and please make a note of the time you took delivery of the Artwork(s). We will then contact the courier to firstly investigate this matter and to seek liability and we will keep you informed of the situation. If the courier company does accept liability, we will arrange the courier to pick up the damaged piece(s) of Artwork(s) before we send you a replacement, we will not send you a replacement until the damaged piece(s) of Artwork(s) has been returned to Artist Unites. We will send you a replacement of the Artwork(s) you ordered/purchased with free shipping immediately after we receive the damaged Artwork(s) we will then produce a new piece(s) of Artwork(s) to complete the re-order. Artist Unites does not carry stock every piece(s) of Artwork(s) is Made To Order and Artist Unites will produce a new piece(s) of Artwork(s) and will be delivered within 30 days. You are agreeing to this by these Terms and Conditions.

9.17 We only replace the damaged Artwork(s) with the same Artwork(s) that has been damaged providing the courier has accepted liability.

9.18 If you accept the delivery and sign or tick if the courier provides the option of ‘NOT CHECKED’ of the Artwork(s) and once you have opened it and it is damaged you must contact us within 36 Hours (3 Days) via email by going to the ‘Contact’ tab in the Menu Bar on our Website and please inform us in detail about what exactly is damaged with the Artwork(s) and please make a note of the time you took delivery of the Artwork(s). We will then contact the courier to firstly investigate this matter and to seek liability and we will keep you informed of the situation. If the courier company does not accept liability and provides us with proof that the Artwork(s) delivered was undamaged when it was delivered then liability is with you and it will be your responsibility to make a claim against the courier company, Artist Unites will not take responsibility or is liable for any claim you make against the courier company. Artist Unites is not liable for any damages or losses.

9.19 If you do not contact us within 36 Hours (3 Days) then we will take no action and you are solely responsible for any investigation or claim against the courier company, Artist Unites will not take responsibility or is liable for any claim you make against the courier company. Artist Unites is not liable for any damages or losses.

9.20 If you accept delivery and sign for the delivery of the Artwork(s) and once you have opened the packaging to discover the Artwork is damaged, you must contact us within 36 Hours (3 Days) via email by going to the ‘Contact’ tab in the Menu Bar on our Website and please inform us in detail about what exactly is damaged with the Artwork(s) and please make a note of the time you took delivery of the Artwork(s). We will then contact the courier to firstly investigate this matter and to seek liability and we will keep you informed of the situation. If the courier company accepts liability, we will arrange the courier to pick up the damaged piece(s) of Artwork(s) before we send you a replacement, we will not send you a replacement until the damaged piece(s) of Artwork(s) has been returned to Artist Unites. We will send you a replacement of the Artwork(s) you ordered/purchased with free shipping immediately after we receive the damaged Artwork(s) if we have the stock in to complete the re-order. Artist Unites does not carry stock every piece(s) of Artwork(s) is Made To Order and Artist Unites will produce a new piece(s) of Artwork(s) and will be delivered within 30 days. You are agreeing to this by these Terms and Conditions.

9.21 We only replace the damaged Artwork(s) with the same Artwork(s) that has been damaged providing the courier has accepted liability.

9.22 If neither the courier company or you accepts liability for a damaged piece(s) of Artwork(s) then Artist Unites will fully investigate the matter to determine liability. It is your responsibility for the cost of the Artwork(s) to be sent back to Artist Unites and we will not proceed with this matter until we have the damaged Artwork(s) in our possession. We will then conduct an examination and investigation through our legal/solicitors to determine liability. Once we determine liability if you are not liable we will send you a replacement of the Artwork(s) if we have the stock to complete the re-order. Artist Unites does not carry stock every piece(s) of Artwork(s) is Made To Order and Artist Unites will produce a new piece(s) of Artwork(s) and will be delivered within 30 days. You are agreeing to this by these Terms and Conditions.

9.23 If neither the courier company or you accepts liability for a damaged piece(s) of Artwork(s) then Artist Unites will fully investigate the matter to determine liability. It is your responsibility for the cost of the Artwork(s) to be sent back to Artist Unites and we will not proceed with this matter until we have the damaged Artwork(s) in our possession. We will then conduct an examination and investigation through our legal/solicitors to determine liability. Once we determine liability if you are liable we will not send a replacement. If you disagree with this decision then its your responsibility to pursue this matter. You are agreeing to this by these Terms and Conditions.

9.24 In the unlikely event the incorrect Artwork(s) is sent to you by mistake by Artist Unites, please contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website and inform us of this matter within 36 Hours (3 Days)of the delivery. We will immediately check our records to confirm this. We will arrange for the incorrect Artwork(s) to be collected by courier, it is your responsibility to make sure the Artwork(s) is packaged safely and in the original packaging. Once the incorrect Artwork(s) has been returned to us in an undamaged condition we will send you the correct ordered/purchased Artwork(s) within 30 working days. Artist Unites does not carry stock every piece(s) of Artwork(s) is Made To Order and Artist Unites will produce a new piece(s) of Artwork(s) and will be delivered within 30 days. You are agreeing to this by these Terms and Conditions. If the incorrect Artwork(s) is returned to us damaged we will fully investigate to seek liability. If the courier company accepts liability we will send you the correct piece(s) of Artwork(s) you ordered/purchased within 30 days. If the courier company does not accept liability we will fully investigate and proceed with an inspection to examine the damaged piece(s) of Artwork(s) and liability is with you then no piece(s) of Artwork(s) will be sent. It is your responsibility to show evidence that the piece(s) of Artwork(s) was undamaged when it was collected by the courier company. If you do not contact us within 36 Hours 3 (Days) then you are responsible for accepting possession of the Artwork(s) accepting liability and Artist Unites is not liable for any damages or losses.

9.25 For international deliveries prices will vary depending on location, size(s), quantities and the weight of the Artwork(s), also insurance for transit will be vary. It is your responsibility to contact us via email by going to the ‘Contact’ tab in the Menu Bar on our Website to ask us for a price for International deliveries.

9.26 If for the reasons set out in our Terms and Conditions that you are responsible for the safe return postage of the Artwork(s) back to Artist Unites and if the Artwork(s) is damaged in transit. Once we receive the Artwork(s) we will inform you via immediately. It is your responsibility to claim against the courier for damages as we will not send a replacement if that is what was arranged given the circumstance of the return. We will help in any way we can by providing you with photographs of the damages to use against your claim. Artist Unites is not liable for any damages or losses.

10. Returns (b).

We only accept returns for the reasons given in the the Delivery, Free Shipping and Returns (a) sections listed in our Terms and Conditions. You are agreeing to these Terms and Conditions.

10.1 Artwork(s) can be returned to us if the Artwork(s) has been damaged by the courier company who accepts liability. Artist Unites will arrange collection from your address in this matter. However you must inform us within 36 Hours (3 Days) of receipt of the Artwork(s) failure to do so will result in you accepting liability and possession of the Artwork(s). Artist Unites is not liable for any damages or losses.

10.2 Artwork(s) can be returned if the incorrect Artwork(s) has been sent to you by mistake and we have checked our records to confirm this. Artist Unites will arrange collection from your address in this matter. The incorrect Artwork(s) must be sent back to us and it is your responsibility to make sure that the Artwork(s) is packaged safely and in the original packaging so it will reach us undamaged. However you must inform us within 36 Hours (3 Days) of receipt of the Artwork(s) failure to do so will result in you accepting liability and possession of the Artwork(s). Artist Unites strongly advises and highly recommends you use a recorded or secure delivery method. Artist Unites is not liable for any damages or losses.

10.3 Artwork(s) can be returned to us if the Artwork(s) has been damaged but neither parties accepts liability and Artist Unites has to conduct an examination and investigation with our legal/solicitors to determine liability. You are responsible for the costs to arrange postage and delivery back to Artist Unites, which the Artwork(s) must reach us in suitable packaging to retain the undamaged areas of the Artwork(s). Artist Unites recommends sending the damaged piece(s) of Artwork(s) in the original packaging. However you must inform us within 36 Hours (3 Days) of receipt of the Artwork(s) failure to do so will result in you accepting liability and possession of the Artwork(s).Artist Unites strongly advises and highly recommends you use a Recorded Delivery or Secure Delivery method. Artist Unites is not liable for any damages or losses.

10.4 Artwork(s) can be returned to us if the Artwork(s) cannot be delivered either because you have not arranged or arranged anyone else to receive the delivery after numerous times (some courier companies have their own policies on how many attempts are made to deliver) or the wrong address was given at the time of your order/purchase and the delivery cannot be made.

10.5 You are agreeing to these Terms and Conditions.

11. Refunds.

11.1 Artist Unites provides a Made To Order Commission and a Made To Order Artwork Service on all the Artwork shown on the Website or any other personal Commission Artwork(s) that is produced. As with all our Artwork(s) produced at Artist Unites is Made To Order and every piece of Artwork(s) is produced by each order/purchase as we only sell Limited Edition Artwork(s). Every piece(s) of Artwork(s) in its description states that it is a Made To Order Commission . Therefore the usual refund policy does not apply to Made To Order, Personalised, Customized, Bespoke goods. By the very nature of the Made To Order Artwork(s) they cannot be guaranteed to be re-sold, and therefore cannot accept refunds. None of the above effects your statutory rights under the Consumer Protection (Distance Selling) Regulations 2000 and 2005 with the exceptions of the supply of personalised goods.

12. Cancellations.

12.1 Our usual policy does not apply to Made To Order goods, which cannot be returned or exchanged.

13.Risk and Title.

13.1 Risk of damage to or loss of the goods (Artwork(s)) shall pass to you at the time of delivery to the specified address once you have accepted the goods (Artwork(s)) from the courier company and taken possession of the goods (Artwork(s)).

14. Risk, Property and Warranties.

Once the Artwork(s) has been delivered and accepted and taken possession by you the Customer/Client/Buyer or any other Third Parties who accept and take possession of on your behalf, you are responsible and liable for the Artwork(s). You the Customer/Client/Buyer would be liable.

14.2 Artist Unites is not responsible or liable for any damages, accidents or health issues either to you the Customer/Client/Buyer or any individuals related or connected to you, groups of people, members of the public or animals. Once the Artwork(s) has been delivered and accepted and taken possession of the Artwork(s) by you the Customer/Client/Buyer or any other Third Parties who accept and take possession of the Artwork(s) on your behalf, you are responsible and liable for the Artwork(s). You the Customer/Client/Buyer would be liable.

14.3 Artist Unites is not responsible or liable for any damages, accidents to any property or anything of value anywhere in the world. Once the Artwork(s) has been delivered and accepted and taken possession of the Artwork(s) by you the Customer/Client/Buyer or any other Third Parties who accept and take possession of the Artwork(s) on your behalf, you are responsible and liable for the Artwork(s). You the Customer/Client/Buyer would be liable.

14.4 Ownership of the Artwork(s) purchased from Artist Unites DOES NOT pass to you, the Customer/Client/Buyer or any Third Parties until we have received the funds of the payment for the Artwork(s).

14.5 Artist Unites DOES NOT give permission for the resale of any Artwork(s) purchased from Artist Unites and the Artist Unites Website, and any breech in this will invalidate your rights under the Terms and Conditions.

14.6 It is illegal to resale, exchange or part with any Artwork(s) purchased from Artist Unites and the Artist Unites Website using the Artist Unites name and the name of the Artist. Any breech in this will be reported to the authorities.

14.7 Every piece(s) of Artwork(s) in our collection produced by Artist Unites has a description including the size of the Artwork(s) (Canvas and Framed). These sizes are approximate as each piece(s) of Artwork(s) is hand made, the frames can alter in size due to stretching and humidity conditions, also as timber is a natural resource it can alter shape and size in different conditions. The description does state sizes as approximate and as much effort is made to ensure an exact size Artist Unites is not liable for slight differences in sizes on receipt and possession of our Artwork(s) by you. Timber, Canvas Material, Acrylic Paint, Watercolour Paint, Gouache Paint, Ready Mix Paint and Drawing Ink all react to changing environments, reaction to heat and cold wet and dry conditions, also all liquids of any description or sharp instruments of any description and objects of any description.

14.8 Artist Unites uses high quality materials but Artist Unites is not liable for any of our Artwork(s) which may change appearance due to these elements listed as well as elements within an environment where our materials are not adapted to changeable conditions.

14.9 The warranty contained in your purchase is subject to the following conditions: (i) The Artwork(s) must be stored in appropriate conditions, if you do not store them in appropriate conditions Artist Unites cannot be held responsible or liable for faults or problems that arise as a result. (ii) Any claim by you in respect of any shortages and/or defects in the Artwork(s) must be notified to us in accordance with these Terms and Conditions, stating the nature of the shortage/defect and quoting the invoice number, if you fail to notify us within the time scale and in the method of contact stated in these Terms and Conditions you will be deemed to have accepted the Artwork(s) you purchased.

15. Your Status.

15.1 By placing an order/purchase with Artist Unites, you warrant that you are legally capable of entering into a binding contract and that you are at least 18 years old. Artist Unites is not responsible or liable for anyone who fraudulently obtains banking or financial information to purchase Artwork(s) from Artist Unites whether they are under 18 or above. Credit Card, Debit Cards or any other Bankers Card information or Payment information is not held by Artist Unites, all financial transactions are processed through Paypal, Cheque or Cash. If a incorrect payment is deducted from your account via whichever method of payment you chose, Artist Unites cannot be held liable for any mistakes or losses to you. 15.2 As stated we do not hold financial information about you at Artist Unites, but the information we do hold such as your name, address and email address, we do not share or pass on your personal information to any Third Parties other than required by law.

15.3 Once an order/purchase has been placed and we have received your details and payment, you are confirming that all the information contained within the order is true and accurate and that you are authorized to make payment. You are entering a legally binding contract with us, giving Paypal permission to deduct the full price of the Artwork(s) from the payment details you have given us. However Artist Unites is not responsible or liable for anyone who fraudulently obtains and uses your financial information or responsible or liable for any mistakes or errors you make during your order/purchase.

15.4 If we are aware we have the right to cancel any orders and if any details are falsely given to us we would cancel, suspend any Artwork(s) delivered to you and report this to the authorities. Anyone who attempts to obtain fraudulently Artist Unites is not responsible or liable for anyone who does obtain your financial information. This is the your responsibility to contact Paypal as all financial transactions are processed through Paypal and not through us.

15.5 If you are aware that your financial information has been used without your authority YOU MUST inform Paypal and your financial services immediately, and YOU MUST contact us via email immediately by going to the ‘Contact’ tab in the Menu Bar on our Website, and inform us of the details and we will report this to the authorities immediately. We will begin our own investigation to confirm that this is accurate with the necessary financial institutions and authorities.

16. Copyright.

All Artwork, Layouts and Designs are the ownership and copyrighted to Artist Unites and it’s owner, all images are the ownership and copyrighted to Artist Unites and it’s owner. Artist Unites company name, logo and content are copyright to Artist Unites and it’s owner. The images used on the Artist Unites Website are the property of Artist Unites and the Artist. You must not reproduce, modify or distribute our images or any part of those images in any manner.

17. Communications.

17.1 When using our the Artist Unites Website, you accept that communication with us will be mainly electronic and through the postal system, we will contact you via email and we ask you to do the same using the option on our Website by going to the ‘Contact’ tab in the Menu Bar on our Website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirements that such communications be in writing.

17.2 Artist Unites will send with the Artwork(s) to the address you give us through Paypal, an Invoice with details about the Artwork(s) and the total price. Also a Certificate of Authenticity will be provided as all of the Artwork(s) produced at Artist Unites is Made To Order.

17.3 Artist Unites will also send letters to the address you provide relating to any of the following:

Made To Order Commission/Made To Order/Artwork/Quote/Information/Photographs/Order/

Purchase/Agreement/Terms and Conditions/Final Approval, Letters and Forms through the post. We will also send post to you if we have difficulty in contacting you for any reason.

17.4 Artist Unites will not send advertising or junk mail.

18. Transfer of Rights and Obligations.

18.1 The contract between you the Customer/Client/Buyer and Artist Unites is binding.

18.2 You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent.

18.3 We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

19. Events Outside of our Control.

19.1 Artist Unites will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control (Force Majeure Event).

19.2 A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

(a) Strikes, lock-outs or other industrial action.

(b) Civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war.

(c) Fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster.

(d) Impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.

(e) Impossibility of the use of public and private telecommunications networks.

(f) The acts, decrees, legislation, regulations or restrictions of any government.

19.3 Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

19.4 Artist Unites uses courier services to deliver and to collect Artwork(s), however we are not connected financially or contractually to any courier service and we are not responsible or liable for any problems they may have during transit. The courier services we use has their own Terms and Conditions and Artist Unites strongly advises and highly recommends that you read their Terms and Conditions if you need to make a claim against them.

19.5 Artist Unites uses high quality materials, however we are not responsible or liable for any materials that are faulty or out of date, we are also not responsible or liable for any delays in the postal system or the courier service used by the companies that produce the materials we use which are sent to Artist Unites.

20. Privacy Policy.

20.1 Artist Unites is totally committed to protecting your privacy. We comply with the principles of the Data Protection Act 1998, the Privacy Electronic Communications (EC Directive) Regulations 2003.

20.2 The Artist Unites Website does not use the facility to join, registry or become an account holder. Our Website is purely for Customers, Clients, Buyers and Art enthusiasts to browse, order and purchase Made To Order Commission Art or Made To Order Artwork.

This information is sent to us by Paypal with whom the purchase is paid to, and we are sent your name and address for delivery purposes only from Paypal. Your name and address is stored on our secure system purely for our records showing our sales through each financial year. Your Email address is only available to use if you contact us through our Website, this is stored by us on our secure system purely to reply and for any further communications.

20.4 Artist Unites does not send advertising or junk mail.

20.5 Artist Unites would never collect information about you without prior agreement. You have to right to ask for a copy of the information which we are holding on you, and we will provide this for a small fee.

21.4 Artist Unites Video’s will contain Visual Images, Techniques and the Artwork Process and although we are allowed to Visually show the Materials and Products we use, we will NOT inform the Viewer any Information where to Purchase the Materials or Products.

21.5 Artist Unites is not liable or responsible for any Viewer who makes any comments about Materials or Products seen on our Video’s to anyone outside Artist Unites either via the Internet, any Media or any other source in which the Public can obtain any such Information.

21.6 Artist Unites Video’s are purely Guidelines in which Techniques, Demonstrations, Informative Information and General Visual Exposure are only used by Artist Unites. Artist Unites is not liable or responsible for anyone who copies and uses our Techniques, uses the Information for their own Artwork or Informs anyone else of our Techniques. The Video’s are there only for the viewer to see how Artist Unites uses the Techniques using Materials and Products.

21.7 Artist Unites Video’s showing Techniques during our Artwork Process using various Materials and Products, any Children copying any of the Techniques must be accompanied by an Adult at all times. Artist Unites is not liable or responsible for any injuries sustained to any individual copying the Techniques seen in our Video’s.
